Adaptive Planning, Inc., (“Adaptive”) has created this Privacy Policy to describe how we treat the information that we collect and receive from our users through the Adaptive Planning web site(s) (“Site”) and the data collected through services provided to our customers (“Customers”), for which we are the data processor. By the accessing and the continued use of the Site you signify your explicit consent to these terms and conditions of our Privacy Policy.

Adaptive Planning has been awarded TRUSTe's Privacy Seal signifying that this privacy policy and practices have been reviewed by TRUSTe for compliance with TRUSTe's program requirements and the TRUSTe Cloud Program Requirements including transparency, accountability and choice regarding the collection and use of your personal information. The TRUSTe program does not cover information that may be collected through downloadable software. Adaptive Planning complies with the U.S. – E.U. Safe Harbor framework and the U.S. - Swiss Safe Harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of data from the European Union and Switzerland respectively. Information Collection and Use on the Site

We collect contact information, such as your name, title, company name, address, phone number, and e-mail address and certain company information, such as annual revenues, number of employees, or industry, from visitors who wish to receive information about Adaptive and its products and services. We use this information to provide you with information about the products and services that we provide and to send information regarding Adaptive or its partners, such as newsletters, promotions and events.

Information Collection and Use through the Service

We require Customers who register to use the services offered on our Site (collectively, the "Service") to give us contact information, such as their name, company name, address, phone number, and e-mail address, and financial qualification and billing information, such as billing name and address, and the number of users within the organization that will be using the Service, and we may also ask for additional information such as title, department name, fax number, and additional company information, such as annual revenues, number of employees, or industry. It is the Customer’s obligation, as the data controller, to inform its registered users about the purposes for which information about them is collected and may be used on this Service. Registered users can update or remove their account information at any time by logging into the Site and editing their account information.

Adaptive uses the account information that we collect to set up the Service for individuals and their organizations. We may also use the account information to contact our registered users to further discuss customer interest in Adaptive and its products and services and the Service that we provide, and to send information regarding Adaptive or its partners, such as newsletters, promotions and events. All financial and billing information that we collect through the Site is used solely to check the qualifications of prospective customers and to bill for the Service. Except as we explicitly state at the time we request information, we do not disclose to third parties the information provided.

Registered users are required to provide an email address when registering for the Service, in order to receive a username and password. We may also email information regarding updates to the Service or Adaptive, and will send a Customer Newsletter. Registered users of the Service will be using the Site to host data and information ("Data"). Adaptive will not review, share, distribute, print, or reference any such Data except as provided in your End User Subscription Agreement, or as may be required by law. Individual records may at times be viewed or accessed for the purpose of resolving a problem, support issue, improving system performance, or suspected violation of the End User Subscription Agreement, or as may be required by law. Users are responsible for maintaining the confidentiality and security of their user registration and password.

Public Forums

Our Web site offers publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, contact us at privacy@adaptiveplanning.com. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

Testimonials

We display personal testimonials of satisfied customers on our site in addition to other endorsements. With your consent we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us at privacy@adaptiveplanning.com.

Log Files

Adaptive Planning may also collect certain anonymous information, such as that pertaining to web pages viewed, to analyze trends, track users’ movements, provide a better website experience and gather broad demographic information for aggregate use.

We use third-party tracking services including Google Analytics, Eloqua, and Leadlander, that use cookies [log files] to track web site visitor information, including web pages viewed and other data, for sales and marketing purposes.

Cookies

Like many websites, Adaptive uses cookies to collect anonymous visitor information. Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your Web browser. They make it possible for us to recognize your browser when you visit and to tell us whether customers and visitors have visited the Site previously.

A cookie is a small text file that is stored on a user's computer for record-keeping purposes. We use cookies on this site. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser's "help" file.

We use both session ID cookies and persistent cookies. We use session cookies to make it easier for you to navigate our site. We use a persistent cookie to record the most recently visited Adaptive Planning server for purposes of routing. This cookie is anonymous and includes no user information.

If you reject cookies, you may still use our application, but your ability to use some areas of our application will be limited.

Third Party Tracking

Adaptive Planning and our third party advertising partners use clear gifs (web beacons), images and scripts. We tie the information gathered to our customers’ personally identifiable information.

We use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients. Information Sharing and Disclosure

Adaptive will not rent, sell, or share personal information about you with other people or nonaffiliated companies except, to provide the Services that you have requested, when we otherwise have your permission, or under the following circumstances:

  • To provide the information to our trusted partners who work on behalf of or with Adaptive under confidentiality agreements. These companies may use your personal information to help Adaptive communicate with you about offers from Adaptive and our marketing partners. These companies do not have any independent right to share this information.
  • To respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims;

Access to Your Account Information and Updating Information

You have the right and ability to edit your account information, at any time. We will respond to your request to access within 30 days.

You can also opt in or out of receiving future communications of special offers and new product information by sending us an email at support@adaptiveplanning.com, or you can unsubscribe by following instructions contained in the messages you receive. We do reserve the right to send you certain communications relating to the Service, such as service announcements and administrative messages, that are considered part of your account membership, and we do not offer you the opportunity to opt-out of receiving those messages.

Data Retention

We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Security

The security of your personal information is important to us. When you enter sensitive information, we encrypt the transmission of that information using secure socket layer technology (SSL).

We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.
